Terms and Conditions

In the following Terms and Conditions, ‘the videographer(s)’ refers to Callum Randall and any videographer appointed by Callum Randall. ‘The client(s)’ shall be those whose name appears on the Booking Form.

1. Display:

The client(s) hereby allow(s) the videographer(s) to display any video and photographs covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums and prints, and other such material, providing that the media used is used lawfully and without damage to the client(s).

2. Licenses, Coverage and Reproduction:

a) The videographer(s) shall be granted artistic license in relation to the poses and action filmed and the locations used. The videographer(s) judgement regarding the location, poses, action and video taken shall be deemed correct.

b) Videos taken during the course of the event will be at the discretion of the videographer(s) although every effort will be made to comply with the client(s) requirements.

c) The videographer(s) shall endeavour to film all individuals as requested by the client(s) at some point, but no responsibility will be taken by the videographer(s) on the occasion of leaving somebody out.

d) For bookings at certain venues the videographer(s) movements are sometimes restricted by the official in charge. The area from which the videographer(s) is able to shoot may not be the videographer(s) choice and the videographer(s) cannot accept responsibility for any obstructed view should this be the case. The use of artificial lighting may be restricted or prohibited. The filming of parts of the event may be restricted or prohibited. Client(s) are strongly advised to check with the appropriate official regarding restrictions before the event.

e) The videographer(s) shall endeavour to capture all the moments throughout the event as they occur. However, because of the fluid nature of events, some moments might not be recorded, or not recorded for logistical reasons.

f) Please note that any alterations made to the booking by the client(s) once details have been confirmed may only be made at the discretion of the videographer(s).

g) Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout the films.

h) Due to limitations of computer monitors it is understood that the films appear differently according to the specification of each monitor.

i) Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the videographer(s) will not be responsible for videos that are not produced due to technical failure, either at the shooting or editing stage.

j) Completion is usually within 6-8 weeks from the date of the event. May be a short delay during peak periods.

3. Prices:

a) The client(s) will be liable to pay any additional expenses incurred by the videographer(s) not already included within the contract price. This includes for example fees charged by some venues, parking expenses, and the dispatch of products to non-UK addresses.

4. Payments:

a) A non-returnable 25% deposit along with this signed form will secure your booking. The deposit forms part of the total cost of your plan (i.e. it is NOT in addition to the cost of the plan) and is deducted when calculating the final balance due. Payment is due in full FOUR WEEKS BEFORE THE DATE OF YOUR EVENT unless otherwise agreed in writing.

Callum Randall Films' preferred payment method is internet bank transfer.

5. Complaints:

a) Any complaints must be received in writing within seven days of receiving the films.

6. Force Majeure:

a) The due performance of the contract is subject to alteration or cancellation by the videographer(s) owing to cause beyond their reasonable control (e.g. sudden illness/injury/cancelled transport/victim of crime/natural disaster/covid isolation).

b) The videographer(s) may contact other videographers in the event that they are not able to attend your booking due to clause 6a). However it may prove difficult or impossible to find a skilled replacement videographer who can offer the full service at short notice or at the same price.

c) In the event of cancellation by the videographer(s), or in the unlikely event of total video failure (although re-shoots may be arranged if practical and possible), the videographer(s) will not be responsible for costs in order to stage re-shoots. The videographer(s) liability shall be limited to a full refund of any deposits and fees paid.

7. Liability for Digital Files and Products:

a) The digital files shall remain the property of the videographer(s) and shall be kept for 3 months from the event date at one site.

b) Should the digital files be lost, damaged or destroyed, the videographer(s) liability shall be limited to a refund of fees paid. No refund will be due for any digital files that have been lost, damaged or destroyed after 3 months from the date of the event.

8. Cancellation Fees:

If the client(s) should have to cancel a booking, the following cancellation fees will become due immediately upon said cancellation.

a) Cancellation more than one month to go until the event date: The non-returnable deposit.

b) Cancellation with less than one month to go until the event date: The full price for the complete service booked.

c) Where the videographer(s) are able to rebook the date with an equivalent booking, then the cancellation fee may be reduced at the videographer(s) discretion to the non-returnable deposit only and any additional cancellation fees already paid may be refunded accordingly.

9. On the Day:

a) The videographer has authority to position themselves for a shot over other non official videographers & photographers. Where possible The Videographer will work with other hired videographers and photographers.

b) Coverage may be cancelled without warning at the discretion of the videographer(s) if the videographer(s) feels threatened or has reason to believe that equipment may be damaged.

10) Secondary Videographer:

a) A secondary videographer may be hired by Callum Randall Films to assist at events. The client(s) will be advised of this prior to the event.

11) Delivery

a) Completion is usually within 4-7 weeks from the date of the event (not including any bank holidays). During peak months completion may be 6-10 weeks.

12) Live Streaming:

a) For events where the live streaming option is taking place every effort will be made for a successful stream. Not all aspects of a stream can be controlled by the videographer.

b)In the event any live stream failure (Internet failure, Streaming services stopping stream etc.) a back up video will be recorded and uploaded after the event.

It is the responsibility of the customer to ensure all event/wedding guests are aware that filming is taking place and their likeness and voice may be recorded and included in final video footage that may be used for marketing purposes as mentioned above.
